Sunrise Marina Lease Terms

1. This contract is for a Marina boat slip, personal watercraft EZ – Doc, kayak, or SUP storage.
2. The use of THE 21^st STREET MARINA is at the sole risk of the boat owner, and THE 21^st STREET MARINA LLC is not liable for the loss or damage of any kind to the boat, her contents, gear, or equipment from any cause whatsoever, including fire, theft, flood, windstorm, hurricane, or other conditions. All vessel owners or lessees must carry liability insurance for their vessel and proof of insurance shall be required to lease a boat or PWC slip.
3. Boat owners are responsible for any damage their boat may cause to the dock structure, pilings, and other boats in the marina. Boat owners are responsible for the correct mooring of their boats in their slips.
4. In case of emergency, the marina reserves the right to take any necessary precautions, at owner’s expense, for the protection of his and other boats in the marina, and shall not be liable for loss, damage or personal injury.
5. Owner gives the marina permission to move boat in the event of impending hazard, but shall not hold the marina liable for damage resulting from either moving or not moving the boat.
6. The marina’s liability from any and all causes shall be limited solely to actual damage incurred as a result of proven negligence on the part of the marina or its employees.
7. Slips may not be subleased, loaned or exchanged. The final acceptance of any boat rests entirely with the marina.
8. THE 21^st STREET MARINA WILL NOT tolerate any discharge of petroleum pollutants either in the water or on the property. Anyone caught dumping will have their slip contracts terminated with NO REFUND, be subject to a fine, and reported to the D.E.P. for criminal action.
9. All trash is to be recycled. Containers are placed on the property and marked for recyclables.
10. Equipment or loose gear may not be stored or left on docks.
11. No cleaning of any items such as fish, engines, etc. is permitted on the docks. A fish cleaning table is provided by the marina.  Please put refuse in cans provided for this.
12. All boats must have a working bilge pump.
13. Living on board boats is not permitted at any time.
14. A set of keys, labeled, must be left in the marina office.
15. Please notify the marina if you plan to be absent from your slip for any length of time.
16. Any boats remaining on the property after the terms of this agreement have expired are subject to daily storage charges of $3.00 per foot per day.
17. Dock boxes are available for rent on a seasonal basis. Only boxes installed by THE 21^st STREET MARINA are allowed.
18. STORAGE PERIOD: May 15^th – October 15^th
19. Dock electric is extra and will be billed to the boat owner.

I acknowledge that I have read this agreement, understand and agree by its terms and conditions, and am in receipt of a copy. This is the ONLY and COMPLETE agreement with regard to the storage of said vessel:

The use of THE MARINA AT AVALON ANCHORAGE is at the sole risk of the boat owner, and THE MARINA AT AVALON ANCHORAGE is not liable for the loss or damage of any kind to the boat, her contents, gear, or equipment from any cause whatsoever, including fire, theft, flood, windstorm, hurricane, or other conditions. All vessel owners or lessees must carry liability insurance for their vessel and proof of insurance shall be required to lease a boat or PWC slip.
